Refund & Cancellation Policy
This Refund & Cancellation Policy ("Policy") explains the refund, cancellation, renewal, and related payment rules that apply to products and services provided by Digital Media Geek ("Digital Media Geek," "DMG," "we," "us," or "our").
This Policy forms part of the Digital Media Geek Terms of Service. By purchasing or renewing a Service, you agree to this Policy and the Terms of Service.
Specific written service agreements, statements of work, proposals, or order terms may contain additional refund or cancellation provisions. If a specific written agreement expressly conflicts with this Policy, the more specific provision controls for that Service.
Nothing in this Policy limits any non-waivable rights available under applicable law or legitimate payment-dispute rights available through a payment provider or payment network.
1. General Policy
Digital Media Geek provides technical and professional services that frequently involve labor, reserved availability, infrastructure provisioning, third-party purchases, or work performed specifically for an individual Customer.
Refund eligibility therefore depends on the type of Service and whether work, provisioning, renewal, or a third-party purchase has already occurred.
Unless otherwise required by law or expressly agreed in writing, refunds are governed by the rules below.
2. One-Time Technical Services
One-time technical Services may include troubleshooting, repair, WordPress work, malware cleanup, website recovery, DNS or SSL work, business email troubleshooting, migrations, technical diagnosis, server work, and similar services.
A qualifying one-time technical Service may be canceled for a refund before Digital Media Geek begins performing the purchased work.
Once Digital Media Geek begins performing the Service, amounts paid for that Service become non-refundable.
Work is considered to have begun when Digital Media Geek starts substantive activity related to the requested Service. This may include investigation, diagnosis, system access, analysis, configuration, repair, migration preparation, remediation, recovery, or other technical work.
Administrative activity such as receiving an order or requesting information does not by itself necessarily mean substantive work has begun.
3. Completed Services
Completed Services are non-refundable except where required by applicable law or expressly agreed otherwise by Digital Media Geek.
A Customer's decision not to use, implement, deploy, or continue using completed work does not create a right to a refund.
4. Technical Diagnosis
Technical diagnosis requires professional time and analysis and may not result in a repair if the issue is outside Digital Media Geek's control, cannot reasonably be corrected, requires additional work, or depends on a third party.
Once substantive diagnostic work begins, the diagnostic Service is non-refundable.
Unless expressly included in the purchased Service, payment for diagnosis does not guarantee that remediation or repair is included.
5. Geek Hours
Geek Hours are prepaid blocks of Digital Media Geek professional or technical service time.
Geek Hours are non-refundable after purchase, whether the hours are:
- completely unused;
- partially used; or
- fully used.
Purchased Geek Hours do not expire unless Digital Media Geek expressly states otherwise in the applicable order or agreement.
The non-expiration of Geek Hours does not create a cash value or right to redeem unused hours for money.
Geek Hours may be subject to reasonable scheduling, service-scope, account, security, and acceptable-use requirements.
6. Monthly Retainers
Monthly retainers and similar recurring professional-service arrangements are non-refundable once the applicable billing period begins.
Cancellation stops future renewal when submitted in accordance with the cancellation requirements in this Policy but does not create a refund for the current billing period.
Unused retainer availability, labor capacity, or other included benefits do not create a refund or credit unless the applicable retainer agreement expressly provides otherwise.
7. Management Services
Recurring server management, cloud infrastructure management, website management, or similar management Services are non-refundable once the applicable billing period begins or renews.
Cancellation applies prospectively according to the cancellation requirements in this Policy.
Management fees already charged for the current billing period are not prorated merely because the Customer cancels before the end of that period.
8. Hosting, VPS, and Dedicated Server Services
Managed Website Hosting, VPS Hosting, Dedicated Server Hosting, and related infrastructure Services become non-refundable once the applicable Service is provisioned or renewed.
This applies to monthly, quarterly, annual, and other applicable billing periods.
Cancellation does not result in a prorated refund for unused time remaining in a billing period.
Customers should therefore submit cancellation requests before the applicable cancellation deadline if they do not want a Service to renew.
9. Service Provisioning
A Service is considered provisioned when Digital Media Geek or an applicable provider has allocated, created, configured, activated, registered, licensed, assigned, or otherwise made resources available for the Customer.
Provisioning may occur before the Customer first logs in or begins actively using the Service.
Failure to use a provisioned Service does not make the Service refundable.
10. Automatic Renewal
Recurring Services automatically renew until canceled unless the applicable order or agreement expressly states otherwise.
Recurring Services may be billed monthly, quarterly, annually, or according to another billing interval disclosed at purchase.
By purchasing a recurring Service and providing a payment method, you authorize Digital Media Geek and its applicable payment processor to charge recurring fees, taxes, and authorized charges at each renewal.
11. Cancellation Deadline
To prevent the next scheduled renewal, Digital Media Geek must receive your cancellation request at least ten (10) days before the applicable billing or renewal date.
If cancellation is received fewer than ten (10) days before the renewal date, the upcoming billing period may renew and the resulting charge may be non-refundable under this Policy.
Customers are responsible for considering weekends, holidays, and other timing issues when submitting cancellation requests.
Digital Media Geek may waive the cancellation deadline in its discretion but is not obligated to do so.
12. How to Cancel
Cancellation may be submitted:
- through the Digital Media Geek customer account or dashboard where cancellation functionality is available; or
- through an authorized Digital Media Geek support request.
Digital Media Geek may require reasonable account or identity verification before processing a cancellation involving sensitive account or infrastructure changes.
A cancellation request is not complete merely because the Customer stops using the Service, removes content, disables a server, removes a payment method, or stops communicating with Digital Media Geek.
13. Effective Date of Cancellation
Unless otherwise agreed, cancellation of a recurring Service becomes effective at the end of the then-current paid billing period.
The Customer may generally continue using the Service through the applicable paid period unless the Service is separately suspended or terminated under the Terms of Service or Acceptable Use Policy.
At the end of the Service period, access may be disabled and Customer data may be deleted according to the applicable service terms and operational procedures.
Customers are responsible for retrieving data they wish to retain before Service termination.
14. Failed Payments
Customers are responsible for maintaining a valid payment method for recurring Services.
If a recurring payment fails, Digital Media Geek may attempt to collect the payment again and may send payment-failure notifications.
A Service may be suspended after payment remains unpaid for three (3) days.
If payment remains unpaid for ten (10) days, Digital Media Geek may terminate the affected Service and may permanently delete associated data, virtual servers, websites, backups, accounts, configurations, or other resources.
Digital Media Geek cannot guarantee recovery or restoration after termination or deletion.
The ordinary payment timeline does not prevent Digital Media Geek from taking faster action when required by law, security conditions, an upstream provider, fraud prevention, network protection, or the Acceptable Use Policy.
15. Recurring Price Changes
Digital Media Geek may change the price of a recurring Service by providing at least thirty (30) days' notice before the new price becomes applicable.
If you do not wish to continue the Service at the new price, you may cancel before the new price takes effect, subject to the applicable cancellation deadline.
Continued renewal after the new price becomes effective constitutes acceptance of the new recurring price to the extent permitted by applicable law.
16. Project Deposits
Deposits paid toward future project work are refundable unless a specific written proposal, statement of work, project agreement, or other accepted agreement expressly states otherwise.
If a refundable deposit is returned, Digital Media Geek may deduct amounts that the Customer separately authorized for non-refundable third-party costs already incurred on the Customer's behalf, to the extent permitted by the applicable agreement and law.
Once project work begins, amounts attributable to work already performed may be subject to the applicable project agreement or one-time-service rules.
17. Third-Party Products and Costs
Charges for third-party products or services generally become non-refundable once Digital Media Geek orders, registers, licenses, renews, allocates, or provisions them for the Customer.
Examples may include:
- domain registrations or renewals;
- software licenses;
- certificates;
- control-panel licenses;
- third-party subscriptions;
- cloud resources;
- IP resources;
- vendor fees; and
- other externally supplied products or services.
Digital Media Geek cannot guarantee that a third-party provider will approve or issue a refund.
If Digital Media Geek actually receives a refundable provider credit associated with a Customer's canceled third-party item, Digital Media Geek may provide an appropriate corresponding refund or credit to the Customer after accounting for non-refundable amounts, fees, or other applicable charges.
18. Services Digital Media Geek Cannot Perform
If Digital Media Geek determines that it cannot perform a purchased Service, we may provide an appropriate resolution based on the circumstances.
That resolution may include:
- a full refund;
- a proportional refund;
- an account credit;
- an alternative Service accepted by the Customer; or
- another mutually acceptable resolution.
If substantial work has already been completed before it becomes clear that the remaining objective cannot reasonably be achieved, any refund may reflect the value of work already performed.
Nothing in this section guarantees that every unsuccessful technical outcome qualifies for a refund. Some technical Services involve diagnosis, attempted recovery, troubleshooting, remediation, or other professional effort for which a particular outcome cannot be guaranteed.
19. Customer-Caused Delays or Inability to Complete Work
A refund is not automatically required when Digital Media Geek cannot complete work because the Customer:
- fails to provide required access;
- provides incorrect or unusable credentials;
- fails to respond to reasonable requests;
- lacks authority over the applicable system;
- changes or damages the system during the work;
- refuses a reasonably necessary step;
- provides inaccurate information;
- violates the Terms of Service or Acceptable Use Policy; or
- otherwise prevents Digital Media Geek from completing the authorized work.
Digital Media Geek may determine an appropriate resolution based on the work performed and circumstances.
20. Technical Outcomes
Many technical Services involve uncertain conditions that cannot be completely known before work begins.
A Service does not become refundable solely because:
- a technical problem cannot be completely repaired;
- lost data cannot be recovered;
- malware damage cannot be completely reversed;
- a third-party product is incompatible;
- a migration requires additional work;
- a third-party provider fails;
- an external service blocks or limits an action;
- an email does not reach a particular inbox;
- a website does not achieve a particular search ranking; or
- a Customer does not achieve a particular business outcome.
This section does not affect a refund that Digital Media Geek expressly approves under Section 18.
21. Acceptable Use Violations
Services suspended or terminated because of a violation of the Digital Media Geek Acceptable Use Policy, Terms of Service, applicable law, or an applicable upstream-provider requirement are generally not eligible for refunds.
Digital Media Geek may also withhold refunds when reasonably necessary to address unpaid charges, abuse-related costs, third-party charges, or other amounts properly owed, to the extent permitted by applicable law.
Nothing in this section authorizes Digital Media Geek to retain funds where doing so would violate applicable law.
22. Fraud and Abuse
Digital Media Geek may deny a refund request that is fraudulent, deceptive, abusive, or based on materially false information.
Digital Media Geek may suspend or terminate accounts associated with payment fraud, repeated abusive refund activity, knowingly improper chargebacks, or other fraudulent conduct.
23. Chargebacks and Payment Disputes
If you believe a charge is incorrect, you are encouraged to contact Digital Media Geek promptly so we can investigate and attempt to resolve the issue.
Nothing in this Policy waives or restricts legitimate payment-dispute rights available under applicable law, payment-network rules, or the terms of your financial institution.
Digital Media Geek may contest a chargeback or payment dispute when we believe the transaction was authorized and properly charged.
When responding to a dispute, Digital Media Geek may provide Stripe, another payment processor, financial institutions, or payment networks with relevant records, including:
- transaction information;
- authorization records;
- account records;
- order information;
- service-delivery records;
- communications;
- access or usage records;
- security logs; and
- other evidence reasonably relevant to the disputed transaction.
24. Refund Method
Approved refunds will generally be returned through the original payment method when reasonably available.
The timing of an approved refund may depend on Stripe, another payment processor, financial institutions, payment networks, or other third parties.
Digital Media Geek does not control how quickly a financial institution posts an approved refund to a Customer's account.
25. Processing Fees
Digital Media Geek may deduct or decline to refund payment-processing fees or other transaction costs only to the extent such treatment is disclosed, permitted by applicable law, and appropriate under the circumstances.
Nothing in this Policy guarantees that processing fees will be deducted from a refund.
26. Credits
Digital Media Geek may offer an account or Service credit as a resolution where appropriate.
Unless expressly agreed otherwise, credits:
- have no cash value;
- cannot be redeemed for cash;
- are not transferable; and
- may be limited to eligible Digital Media Geek Services.
A Customer is not required to accept a credit instead of a refund where applicable law requires a monetary refund.
27. Promotional and Discounted Services
Promotional pricing, coupons, discounts, credits, or special offers do not create additional refund rights unless expressly stated in the applicable promotion.
If an eligible refund applies to a discounted purchase, the refund will generally be based on the amount actually paid rather than the undiscounted price.
28. Service Changes and Upgrades
Upgrades, downgrades, resource changes, or other Service modifications may affect billing according to the applicable Service terms.
Digital Media Geek will disclose applicable charges when reasonably practical before a Customer-authorized change.
A Customer-requested change does not automatically create a refund for previously purchased resources or time.
29. Duplicate or Incorrect Charges
If Digital Media Geek confirms that you were charged more than once for the same transaction in error, charged an incorrect amount, or charged after a properly completed cancellation that should have prevented renewal, Digital Media Geek will take appropriate steps to correct the billing error.
Correction may include a refund, reversal, credit, or other appropriate adjustment.
You should report suspected billing errors promptly.
30. Taxes
Refunds of taxes, duties, or similar governmental charges may depend on applicable law and the manner in which the original charge was collected or remitted.
Digital Media Geek will handle tax adjustments associated with approved refunds as required by applicable law.
31. Upstream Provider Actions
Digital Media Geek relies on third-party infrastructure, network, software, security, payment, and other providers.
An upstream provider may suspend, terminate, restrict, modify, or discontinue a resource because of abuse, security, legal, payment, technical, or operational requirements.
An upstream-provider action does not automatically create a refund right.
Digital Media Geek will determine refund eligibility under this Policy, the Terms of Service, the circumstances of the provider action, and applicable law.
32. Service Discontinuation by Digital Media Geek
If Digital Media Geek permanently discontinues a prepaid Service for business reasons unrelated to Customer breach, abuse, nonpayment, or other Customer-caused circumstances, Digital Media Geek may provide an appropriate proportional refund, credit, migration option, replacement Service, or other reasonable resolution for unused prepaid service time.
The appropriate resolution may depend on the Service and circumstances.
33. How to Request a Refund
Where this Policy permits a refund request, contact Digital Media Geek through an authorized support channel and provide information reasonably necessary to identify:
- your account;
- the applicable order or transaction;
- the Service involved; and
- the reason for the request.
Digital Media Geek may request additional information reasonably necessary to investigate the request.
Submitting a refund request does not itself guarantee approval.
34. Relationship to Other Policies
This Policy should be read together with the Digital Media Geek Terms of Service, Privacy Policy, Acceptable Use Policy, and any applicable service-specific agreement.
The Terms of Service govern the overall contractual relationship.
The Acceptable Use Policy governs permitted and prohibited activity.
The Privacy Policy describes Digital Media Geek's personal-information practices.
For refund and cancellation matters, this Policy controls over a general summary contained in the Terms of Service unless a more specific written agreement expressly provides otherwise.
35. Changes to This Policy
Digital Media Geek may update this Policy as Services, billing practices, providers, or legal requirements change.
The current version will be available through the Digital Media Geek website and will identify its effective date.
For material changes affecting existing recurring Services, Digital Media Geek may provide reasonable notice through email, account notification, website notice, or another appropriate method.
Changes will not retroactively eliminate rights that cannot lawfully be altered.
